ORDER
The claimant moves the Full Commission to allow filing of a belated brief. An administrative law judge filed an opinion on July 9, 2009, and the respondents filed a timely notice of appeal. The Clerk of the Commission corresponded with the parties on September 10, 2009 and stated in part, “This case will be submitted to the Full Commission on November 4, 2009. Respondent’s brief will be due October 2, 2009. Claimant’s brief will be due October 16, 2009. . . . Any extension request must be submitted in writing prior to

the due date. Extension requests must be agreed to by all parties and good cause must be shown.”
The Commission’s file does not show that the respondents filed a brief by October 2, 2009. The claimant did not file a brief until October 22, 2009. The claimant moves to file a belated brief and states in part, “The Claimant’s Brief was filed 6 days late due to the error of Claimant’s counsel in misreading the September 10, 2009 letter from the Commission.” Because the claimant’s motion was untimely filed, we find that it must be denied. See Franklin v. Cross County Judge, Workers’ Compensation Commission F810601 (July 31, 2009).
