CLAIM NO. F108393
Before the Arkansas Workers’ Compensation Commission
ORDER FILED FEBRUARY 20, 2002
Upon review before the FULL COMMISSION in Little Rock, Pulaski County, Arkansas.
Claimant represented by the HONORABLE JAY TOLLEY, Attorney at Law, Fayetteville, Arkansas.
Respondents represented by the HONORABLE CURTIS NEBBEN, Attorney at Law, Fayetteville, Arkansas.
ORDER
This matter comes before the Full Commission on the claimant’s request for an order directing the delivery of the incarcerated claimant to Washington County for attendance as a witness at a hearing on the claimant’s claim for Workers’ Compensation benefits. Our research indicates that only a Circuit Judge has authority to issue an order directing the Department of Correction to bring a prisoner to be a witness outside his county of incarceration, and that statutory authority also appears to be limited to incarcerated witnesses for criminal
proceedings. See Ark. Code Ann. § 16-43-213 and 214. Therefore, the claimant’s request must be, and hereby is denied.
IT IS SO ORDERED.
