CLAIM NO. F804013
Before the Arkansas Workers’ Compensation Commission
ORDER FILED MAY 23, 2011
Upon review before the FULL COMMISSION, Little Rock, Pulaski County, Arkansas.
Claimant represented by the HONORABLE GARY DAVIS, Attorney at Law, Little Rock, Arkansas.
Respondents No. 1 represented by the HONORABLE JOSEPH PURVIS, Attorney at Law, Little Rock, Arkansas.
ORDER
The respondent in the above-styled matter moves the Commission to allow filing of a belated brief. The claimant has appealed an Administrative Law Judge’s opinion filed February 1, 2011. Correspondence to the parties from the Clerk of the Commission expressly states, “Respondents’ brief will be due April 15, 2011 . . . If either party elects not to file a brief pursuant to this schedule, please so advise in writing.” The respondents did not file their motion to file a belated brief until April 20, 2011. Since the respondents’ motion was untimely filed, we find it must be denied. Franklin v. Cross CountyJudge,

The Full Commission, therefore, denies the respondents’ motion to file a belated brief.
