ORDER
This case comes on for review before the Commission on Respondent No. 1’s motion for an extension of the briefing schedule.

After our consideration of Respondent No. 1’s motion and all other matters properly before the Commission, we find that this motion must be denied.

Respondent No. 1’s brief was due Friday, September 17, 2004. On Monday, September 20, Respondent No. 1 filed the present motion indicating that it had simply missed the deadline.

Correspondence from the Commission establishing the briefing schedule clearly states that “[a]ny extension request must be submitted in writingprior to the due date.” (Original emphasis.) Since Respondent No. 1’s motion was untimely filed, it must be denied.

Accordingly, we find that Respondent No. 1’s motion to extend the briefing schedule should be, and hereby is, denied.
