CLAIM NO. F303479
Before the Arkansas Workers’ Compensation Commission
ORDER FILED APRIL 18, 2005
Upon review before the FULL COMMISSION, Little Rock, Pulaski County, Arkansas.
Claimant appeared pro se.
Respondent represented by MICHAEL DENNIS, Attorney at Law, Pine Bluff, Arkansas.
ORDER
This matter is presently before the Commission on Claimant’s motion to introduce additional evidence on a claim that has been appealed from the Full Commission to the Arkansas Court of Appeals. After consideration of the claimant’s motion, the respondents’ response thereto, and all other matters properly before the Commission, we find that the claimant’s motion must be denied.
In an opinion issued February 24, 2005, the Full Commission found that the claimant sustained a compensable injury in the form of right extremity carpal tunnel syndrome. The claimant has appealed from the finding that he did not prove by a preponderance of the evidence that he sustained a compensable left extremity carpal tunnel syndrome injury. In connection with filing his notice of appeal, the claimant filed the present motion to submit additional evidence for consideration.
A.C.A. § 11-9-711(b)(3)(A) specifically states that upon appeal to the Court, no additional evidence shall be heard. As the Full Commission has rendered its opinion on this claim and the claimant has filed a notice of appeal from the Full Commission opinion, we find that the claimant’s motion must be denied.
IT IS SO ORDERED.
