CLAIM NO. F002317
Before the Arkansas Workers’ Compensation Commission
ORDER FILED DECEMBER 19, 2001
Upon review before the FULL COMMISSION in Little Rock, Pulaski County, Arkansas.
Claimant represented by the HONORABLE DALE GRADY, Attorney at Law, Bryant, Arkansas.
Respondents represented by the HONORABLE JOSEPH E. KILPATRICK, JR., Attorney at Law, Little Rock, Arkansas.
ORDER
This case comes on for review before the Commission on multiple motions filed by claimant.
After our consideration of claimant’s motions, respondent’s response thereto, and all other matters properly before the Commission, we find that this matter must be remanded to the Administrative Law Judge. Claimant’s motions center around the allegation that respondent has failed to comply with the Administrative Law Judge’s November 2000 award of benefits. While it appears from the pleadings that respondent may have eventually paid some benefits, allegations remain as to penalties, interest on the award, and controverted attorney’s fees. A record concerning these allegations should be developed in proceedings before the Administrative Law Judge.
For the foregoing reasons, we remand this matter to the Administrative Law Judge to hold any proceedings necessary to determine the issues raised in claimant’s motions and to render a decision thereon. Further, the parties may certainly present any remaining issues that are ripe for a decision.
IT IS SO ORDERED.
