CLAIM NOS. E214467 E216882

ROD BRIDGES, EMPLOYEE, CLAIMANT v. ALUMAX, INC., EMPLOYER, RESPONDENT and CONTINENTAL INSURANCE COMPANY, INSURANCE CARRIER, RESPONDENT

Before the Arkansas Workers’ Compensation Commission
ORDER FILED DECEMBER 2, 1999

Upon review before the FULL COMMISSION in Little Rock, Pulaski County, Arkansas.

Claimant represented by DALE GRADY, Attorney at Law, Bryant, Arkansas.

Respondents represented by KEVIN STATEN, Attorney at Law, Little Rock, Arkansas.

ORDER
This case comes on for review before the Commission on claimant’s Response to Respondents Response (Objection) to Notice of Appeal and Motion for Remand and Motion for Full Commission to Remand to Another Law Judge.

After our consideration of claimant’s motions, respondents’ responses thereto and all other matters properly before the Commission, we find that claimant’s motions should be denied.

In our opinion, the claimant has offered insufficient reason for the Commission to remand this case. Claimant has failed to raise a legally adequate basis to remand this claim and has raised no argument for the introduction of new evidence. Because we have determined that claimant has raised no arguments which merit remanding this case claimant’s request that it be remanded to another Administrative Law Judge is rendered moot. In reaching this conclusion we note that the bulk of claimant’s pleadings deal with issues that are appropriately the subject matter of an appeal. Claimant has filed a timely notice of appeal and we assume that claimant will advance those arguments in that context.

Accordingly, we find that claimant’s Motion for Remand and Motion for Full Commission to Remand to Another Law Judge should be, and hereby are, denied.

IT IS SO ORDERED.
