CLAIM NO. F807722

BLANCA R. CORTEZ, EMPLOYEE CLAIMANT v. HOSTO BUCHAN PLLC, EMPLOYER RESPONDENT CONTINENTAL CASUALTY COMPANY, INSURANCE CARRIER RESPONDENT

Before the Arkansas Workers’ Compensation Commission
OPINION FILED JANUARY 27, 2009

Upon review before the FULL COMMISSION in Little Rock, Pulaski County, Arkansas.

Claimant represented by the HONORABLE GARY DAVIS, Attorney at Law, Little Rock, Arkansas.

Respondent represented by the HONORABLE LEE J. MULDROW, Attorney at Law, Little Rock, Arkansas.

ORDER
The respondents in the above-styled matter move to dismiss the claimant’s appeal. The Full Commission grants the respondents’ motion. In an order filed November 20, 2008, an administrative law judge granted the respondents’ motion to compel and ordered that the parties shall reconvene a deposition. The administrative law judge found that the claimant was responsible for court reporting costs associated with the required follow-up deposition.

The administrative law judge’s November 20, 2008 order is not a final and appealable order. See TEC v. Falkner, 38 Ark. App. 11, 826 S.W.2d 313 (1992). The Full Commission therefore dismisses the claimant’s appeal of the administrative law judge’s November 20, 2008 order.

IT IS SO ORDERED.
