CLAIM NO. E112173

ARLENE DENISE DIXON, EMPLOYEE, CLAIMANT v. BAXTER COUNTY REGIONAL HOSPITAL, EMPLOYER, RESPONDENT RISK MANAGEMENT RESOURCES, CARRIER, RESPONDENT

Before the Arkansas Workers’ Compensation Commission
ORDER FILED MARCH 2, 2006

Upon review before the FULL COMMISSION, Little Rock, Pulaski County, Arkansas.

Claimant represented by Honorable Frederick Spencer, Attorney at Law, Mountain Home, Arkansas.

Respondent represented by Honorable Walter A. Murray, Attorney at Law, Little Rock, Arkansas.

ORDER
Presently before the Commission is Respondent’s Renewed Request for Oral Arguments. After consideration of respondent’s motion and all other matters properly before the Commission, we find that respondent’s motion should be denied.

This claim has been remanded to the Full Commission from the Arkansas Court of Appeals. In its opinion rendered November 16, 2005, the Court instructed the Commission to render specific findings of fact upon whether the claimant is claiming additional benefits under A.C.A. § 11-9-702 or whether she is seeking a modification of a previous award under A.C.A. § 11-9-713, or whether she is seeking both. After the claim is placed upon our docket and the parties’ briefs and arguments are reviewed, we may, on our own motion, reconsider whether to call for oral arguments. However, at this time we find that a determination as to the need for oral arguments is premature. Therefore, we find that respondent’s motion should be, and hereby is, denied.

IT IS SO ORDERED.
