CLAIM NO. F408476
Before the Arkansas Workers’ Compensation Commission
OPINION FILED APRIL 19, 2006
Upon review before the FULL COMMISSION in Little Rock, Pulaski County, Arkansas.
Claimant represented by the Honorable Stephen M. Sharum, Attorney at Law, Fort Smith, Arkansas.
Respondents represented by the Honorable E. Diane Graham, Attorney at Law, Fort Smith, Arkansas.
ORDER
The respondent moves the Full Commission to clarify its March 28, 2006 opinion. The Full Commission grants the respondent’s motion.
The parties stipulated that the claimant sustained a compensable injury to her left ankle on September 10, 2003. A pre-hearing order was filed on November 3, 2004. The claimant contended, among other things, that she was entitled to temporary total disability compensation beginning September 17, 2003 to a date to be determined. The parties agreed to litigate several issues, including whether the claimant sustained a compensable injury to her low back or lumbar spine; the claimant’s entitlement to additional medical treatment; the claimant’s entitlement to several periods of temporary total disability; whether the claimant sustained reflex sympathetic dystrophy as a compensable consequence of her compensable injury; and whether the claimant sustained a compensable injury to her left leg.
An administrative law judge filed an opinion on March 31, 2005. The administrative law judge found, among other things, that the claimant failed to prove she sustained compensable injuries to her lower back or left leg, and that the claimant failed to prove she sustained a compensable injury or compensable consequence in the form of reflex sympathetic dystrophy. The administrative law judge reserved the issue of additional medical treatment or temporary total disability compensation, pending an evaluation of the claimant at University of Arkansas for Medical Sciences. Counsel for the respondent subsequently scheduled an appointment for the claimant with Dr. Ruth Thomas at UAMS.
In an opinion filed March 28, 2006, the Full Commission affirmed and adopted the administrative law judge’s March 31, 2005 decision. The respondent requests that the Full Commission “clarify its March 28, 2006 Opinion and Order setting out its findings regarding whether Claimant is entitled to additional medical treatment or to temporary total disability benefits.”
The Full Commission grants the respondent’s motion for clarification. The Full Commission informs the parties that the issues of additional medical treatment and temporary total disability compensation remain reserved. We note that the report from Dr. Thomas at UAMS has not yet been included in the record before the Commission. The Full Commission also notes that we have affirmed and adopted the administrative law judge’s findings that the claimant did not sustain a compensable injury to her lumbar spine or left leg.
The Full Commission has not adjudicated the claimant’s entitlement to temporary total disability compensation or additional medical treatment. We again note that the report from Dr. Thomas at UAMS has not yet been submitted into the record before the Full Commission.
IT IS SO ORDERED.
