This matter comes on for review before the Commission on claimant’s Motion to Dismiss Appeal. After our consideration of the claimant’s motion, and respondent’s response thereto, we find that claimant’s motion should be denied. The respondent received the Administrative Law Judge’s Order by certified mail on February 16, 2010. Therefore, the respondent’s March 17, 2010 Notice of Appeal was filed within the thirty (30) day time

frame set by Commission Rule 099.13. The claimant’s Motion to Dismiss Appeal must be and hereby is denied.
