APPEAL ERROR — MOTION FOR RULE ON THE CLERK — GOOD CAUSE FOR GRANTING. — An admission by an attorney for a criminal defendant that the record was tendered late due to a mistake on his part was good cause to grant a motion for rule on the clerk.

The appellant, by his attorney, John F. Gibson, Jr., has filed a motion for a rule to require the clerk to file the record in this case after the expiration of the time allowed. The attorney admits that the delay in filing the record was his fault.
