CLAIM NOS. E212807, E705641, E803442, F011930
Before the Arkansas Workers’ Compensation Commission
ORDER FILED JUNE 29, 2010
Upon review before the FULL COMMISSION in Little Rock, Pulaski County, Arkansas.
Claimant appears pro se.
Respondents represented by the HONORABLE NEAL HART, Attorney at Law, Little Rock, Arkansas.
ORDER
This matter comes on for review before the Commission on respondent’s Motion to Exclude Additional Evidence.
After our consideration of respondent’s motion, and all other matters properly before the Commission, we find that respondent’s motion should be granted. Ark. Code Ann. § 11-9-705(c)(1)(A) states:
Page 2
All oral evidence or documentary evidence shall be presented to the designated representative of the commission at the initial hearing on a controverted claim, which evidence shall be stenographically reported.
The claimant was afforded ample opportunity to introduce evidence at the initial hearing. The claimant has attached medical exhibits to her Notice of Appeal without making a Motion to Introduce Additional Evidence. This is improper. Accordingly, we find that respondent’s Motion to Exclude Additional Evidence should be granted. All medical reports attached to claimant’s Notice of Appeal, should be, and hereby are, excluded.
IT IS SO ORDERED.
