CLAIM NOS. F303464, F303465

MEGAN SMITH, EMPLOYEE, CLAIMANT v. O’RIELLY AUTOMOTIVE, INC., EMPLOYER, RESPONDENT, AMERICAN CASUALTY COMPANY OF READING PENNSYLVANIA, CARRIER, RESPONDENT

Before the Arkansas Workers’ Compensation Commission
ORDER FILED AUGUST 24, 2004

Upon review before the FULL COMMISSION, Little Rock, Pulaski County, Arkansas.

Claimant represented by HON. DAVID L. ETHREDGE, Attorney at Law, Mountain Home, Arkansas.

Respondent represented by HON. CYNTHIA KOLB, Attorney at Law, Little Rock, Arkansas.

ORDER
Presently before the Commission is Counsel for Respondents’ Motion to Withdraw as Counsel. No response has been filed to the motion. After consideration the motion, and all other matters properly before the Commission, we find that the motion should be granted.

The respondents requested that the Barber Law Firm withdraw from representation. No prejudice will result by counsel’s withdrawal as the notice of appeal has already been filed with the Commission. Moreover, the Commission file reflects that the respondents have retained new counsel to represent them on appeal.

Accordingly, we find that the Barber Law Firm should be granted leave to withdraw its representation of the respondents. Therefore, we find that the motion to withdraw should be granted.

IT IS SO ORDERED.
