[2] This case comes on for review before the Commission on claimant’s motion to dismiss respondent’s appeal to the Commission as being untimely filed. [3] After our consideration of claimant’s motion, respondent’s objection thereto and all other matters properly before the Commission, we find that claimant’s motion should be denied. [4] Pursuant to Ark. Code Ann. § 11-9-711(a)(1) (Repl. 1996) respondent had 30 days from the receipt of the opinion of the Administrative Law Judge to file an appeal to the Full Commission. Respondent received the Administrative Law Judge’s opinion on June 8, 1998. The appeal to the Commission was filed on July 6, 1998, 28 days following receipt of the opinion of the Administrative Law Judge. [5] Accordingly, we find that claimant’s motion to dismiss respondent’s appeal to the Commission should be, and hereby is, denied. The Clerk of the Commission is directed to establish another briefing schedule forthwith. [6] IT IS SO ORDERED.
