CLAIM NO. E310658
Before the Arkansas Workers’ Compensation Commission
ORDER FILED AUGUST 28, 1998
Upon review before the FULL COMMISSION in Little Rock, Pulaski County, Arkansas.
Claimant represented by FREDERICK S. “RICK” SPENCER, Attorney at Law, Mountain Home, Arkansas.
Respondent No. 1 represented by E. DIANE GRAHAM, Attorney at Law, Fort Smith, Arkansas.
Respondent No. 2 represented by TERRY PENCE, Attorney at Law, Little Rock, Arkansas.
[1] ORDER[2] This case comes before the Full Commission on remand from the Arkansas Court of Appeals. On December 9, 1996, the Administrative Law Judge filed an opinion awarding benefits for permanent anatomical impairment. On August 7, 1997, the Full Commission affirmed and adopted the Administrative Law Judge’s findings and conclusions and award of compensation. However, the Court of Appeals delivered an opinion on May 27, 1998 finding that the Administrative Law Judge failed to make adequate findings necessary for the court to determine whether the relevant issues were resolved in conformity with the law. [3] Therefore, we find that the case must, and hereby is, remanded to the Administrative Law Judge to make specific findings of fact in accordance with the mandate of the Arkansas Court of Appeals. [4] IT IS SO ORDERED.
