[1] ORDER[2] This case comes on for review before the Commission on respondent’s motion to file a belated brief. [3] After consideration of respondent’s motion, and all other matters properly before the Commission, we find that respondent’s motion must be denied. [4] Respondent’s brief on appeal was due June 25, 1999. The present motion was not filed with the Commission until July 19, 1999. [5] Correspondence from the Commission establishing the original briefing schedule clearly states that “[a]ny extension request must be submitted in writing prior to the due date.” Respondent’s motion was filed over three weeks beyond the due date for the brief. Since respondent’s motion was untimely filed, we find it must be denied. See, McGraw v. Arkansas Delivery Services, Full Workers’ Compensation Commission, Opinion filed March 31, 1999. [6] Accordingly, we find that respondent’s motion to file a belated brief should be, and hereby is, denied. [7] IT IS SO ORDERED. [8] ________________________________
