CLAIM NO. E516250

MARY WILLIAMS, EMPLOYEE, CLAIMANT v. COLSON CASTER CORPORATION, SELF-INSURED EMPLOYER, RESPONDENT

Before the Arkansas Workers’ Compensation Commission
ORDER FILED OCTOBER 16, 1996

Upon review before the FULL COMMISSION in Little Rock, Pulaski County, Arkansas.

Claimant represented by CHRISTOPHER LEIF HAMMAN, Attorney at Law, Jonesboro, Arkansas.

Respondents represented by RICHARD LUSBY, Attorney at Law, Jonesboro, Arkansas.

[1] ORDER
[2] This case comes on for review before the Commission on claimant’s motion to dismiss respondent’s appeal to the Commission.

[3] After our consideration of claimant’s motion, and all other matters properly before the Commission, we find that claimant’s motion is without merit and should be denied. [4] Claimant contends that the award of benefits by the Administrative Law Judge was against Colson Caster Corporation and Sedgwick James of Arkansas. Respondent’s notice of appeal identifies Colson Caster Corporation as a self-insured employer, but does not mention Sedgwick James of Arkansas. Claimant appears to contend that Colson Caster Corporation is not a self-insured employer. However, Colson Caster Corporation is, in fact, a self-insured employer and Sedgwick James of Arkansas is the employer’s third-party administrator. [5] Additionally, claimant contends that the appeal should be dismissed for failure to comply with Rule 3 (e) of the Arkansas Rules of Appellant Procedure. The short answer to this contention is simply that the Arkansas Rules of Appellate Procedure have no application to cases appealed from an Administrative Law Judge to the Full Commission. [6] For the foregoing reasons, we find that claimant’s motion to dismiss respondent’s appeal to the Commission should be, and hereby is, denied. [7] IT IS SO ORDERED.

JAMES W. DANIEL, Chairman PAT WEST HUMPHREY, Commissioner ALICE L. HOLCOMB, Commissioner
