This claim is presently before the Commission on Remand from the Court of Appeals to settle the record. The March 1, 2004, deposition of Dr. Kenneth Rosenzweig was inadvertently omitted from the official transcript prepared by the Clerk of the Commission. The deposition is a part of the record and was considered by both the Administrative Law Judge and the Full Commission. The Clerk of the Commission is hereby ordered to include the March 1, 2004, Deposition of Dr. Kenneth Rosenzweig as part of the official record, and to file the corrected record with the Court of Appeals.
